I. General provisions
At Jan Barba, we respect consumer rights. Any doubts should be interpreted in favor of the consumer.
Definitions:
- Terms and Conditions – these Terms and Conditions of the online store.
- Seller – Jan Barba Spółka z ograniczoną odpowiedzialnością, Cybulice Małe, ul. Wesoła 37, 05-152 Czosnów, NIP: 531-171-42-76, REGON: 521450441, KRS: 0000958974, e-mail: hi@janbarba.com.
- Client – (1) a natural person with full legal capacity, and where applicable a natural person with limited legal capacity; (2) a legal person; or (3) an organizational unit without legal personality recognized by law as having legal capacity, who uses or intends to use the online store services.
- Online Store – the online store available at janbarba.com operated by the Seller.
- Registration form – a form available in the Online Store allowing account creation.
- Order form – a form available in the Online Store allowing order placement, defining product(s), delivery, and payment methods.
- Account – a set of resources in the Seller’s IT system collecting Client’s data and information on placed orders.
- Sales contract – a contract for product sale concluded between Client and Seller via the Online Store.
- Product – a movable item available in the Online Store that is the subject of the sales contract.
- Order – a Client’s declaration of intent submitted via the Order Form aimed at concluding a sales contract.
II. The procedure for concluding a sales contract in the Online Store
The sales contract between Client and Seller is concluded once the Client places an order via the Online Store.
The entity providing online card payment services is Blue Media S.A. Available payment methods include Bank Transfer, Fast Transfer and Blik Paynow, and Payment Cards: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro.
After placing an order, the Seller immediately confirms receipt by sending an email to the Client’s email address provided during order placement, and simultaneously accepts the order for fulfillment. Upon receipt of this email by the Client, the sales contract is concluded.
III. Conditions for concluding a sales contract
The product price displayed on the Online Store website is in Polish zlotys (PLN) and includes taxes.
IV. Terms of payment for the product
The Client is obliged to make payment within 7 calendar days from the date of conclusion of the sales contract.
V. Cost, methods and date of delivery and collection of the product
Product delivery to the Client is payable unless otherwise stated in the sales contract. Delivery costs (including transport, delivery, and postal charges) are indicated to the Client when placing the order.
The delivery date depends on the postal service provider. If payment is made by bank transfer or card, order fulfillment time is counted from the date the Seller’s bank account is credited.
VI. Product complaint
- If the sold product has a physical or legal defect (warranty), the provisions of the Civil Code apply.
- A complaint may be submitted by the Client:
- in writing to: Cybulice Małe, ul. Wesoła 37, 05-152 Czosnów;
- or electronically via email: hi@janbarba.com.
- The Seller will respond to the complaint within 14 calendar days from the date of submission.
- The Client exercising warranty rights must deliver the defective product at the Seller’s expense to: Cybulice Małe, ul. Wesoła 37, 05-152 Czosnów.
VII. The right to withdraw from the contract
- The Client who concluded a distance contract may withdraw from it within 14 calendar days without giving any reason and without incurring costs, except for shipping costs and other costs borne by the Seller to complete the sale. To meet the deadline, sending a withdrawal statement before expiry is sufficient. The withdrawal statement can be submitted:
- in writing to: Cybulice Małe, ul. Wesoła 37, 05-152 Czosnów;
- or electronically via email: hi@janbarba.com.
- The withdrawal period begins when the Client or a third party other than the carrier takes possession of the product.
- Upon withdrawal, the contract is considered void.
- The Seller shall return all payments within 14 calendar days from receiving the withdrawal statement, excluding delivery costs and related sale costs. Refunds will be made using the same payment method unless the Client agrees otherwise without costs.
- The Seller may withhold refund until the product is returned. The Client must return the product immediately, no later than 14 calendar days from withdrawal. Returning before the deadline is sufficient. Return address: Cybulice Małe, ul. Wesoła 37, 05-152 Czosnów.
- Due to sanitary reasons, only products that have NOT been opened, used, unsealed, or physically touched can be returned.
- Products with short use-by dates or which cannot be returned after opening due to health or hygiene reasons are excluded from withdrawal rights.
- The right of withdrawal does not apply to non-prefabricated products made per Client specifications or personalized to their individual needs.
- Costs related to withdrawal shall be borne by the Client.
- If a partial return causes the value of retained products to fall below the free delivery threshold, the Seller reserves the right to deduct the standard shipping cost from the refund, based on the shipping price effective at the time of the order.
VIII. Personal data protection

- Personal data is processed for:
- order fulfillment,
- legal obligations (financial and accounting documents),
- legitimate interests (e.g. debt collection, complaints, returns, marketing).
- Processing is based on: contract execution (Art. 6(1)(b) GDPR), legal obligation (Art. 6(1)(c)), and legitimate interest (Art. 6(1)(f)).
- With consent, data may be used to send commercial electronic information.
- Personal data about visited sites and purchases may be used for profiling via cookies.
- Consent may be withdrawn at any time by contacting: hi@janbarba.com.
- Providing data is voluntary, but refusal to provide necessary data prevents order processing.
- Data may be shared with trusted third-party service providers bound to protect data.
- Clients have rights to access, correct, object, delete, or transfer their data, subject to legal exceptions.
IX. Final Provisions
- Contracts concluded via the Online Store are in Polish and governed by Polish law.
- Amendments to these Terms and Conditions may be made for important reasons, such as changes in law, payment or delivery methods affecting contract execution.
- Matters not covered by these Terms are governed by applicable Polish law.
